I think Feingold raises a point we all need to remember. If we can just hang in there for the next few months and stay behind Obama, these are all things that can be reversed when we have a Democratic President working with a Democratic Congress. That's not to say that all Democratic ideals will be instituted - they don't suit everyone - but some of these outright illegal measures can be fixed. Patriot Act, Military Commissions Act, FISA bill. They do it all the time. A bill is passed, the next administration undoes it.

Someone passed Prohibition at one point, right? Then it was repealed. In the end, I do think the right action wins out. It just takes a while sometimes because you don't have an appropriate balance of power in Washington.

The US is a big country - political change takes time when you do it right. They could go in like Bush and just assert they have certain rights to do what they want, but wouldn't that make them hypocrites?
